Provisional Authority

Trucking companies and individuals in the Philippines who want to operate a trucking business must secure a Provisional Authority (PA) from the Land Transportation Franchising and Regulatory Board (LTFRB). This document has a validity limited only to up to three months and grants temporary permission to operate while the full Certificate of Public Convenience (CPC) is being processed.

Requirements for Provisional Authority for Trucking (LTFRB)

The general steps and requirements for obtaining a Provisional Authority are as follows:

1. Letter of Intent (LOI)

• A formal letter addressed to the LTFRB, expressing your intent to apply for a PA to operate a trucking service.

2. Duly Accomplished Application Form

• Obtain and fill out the application form provided by the LTFRB. This can usually be downloaded from their official website or obtained at the LTFRB office.

3. Proof of Ownership or Contract

• For Owner-Operator: Present each truck's official receipt (OR) and Certificate of Registration (CR) under your name.

• For Lease: Provide a notarized lease contract if you are leasing trucks.

4. Franchise Verification

• If you are adding new units to an existing CPC, secure a franchise verification certificate from the LTFRB.

5. DTI or SEC Registration

• Submit a copy of your business registration.

  • For Sole Proprietorship: Provide DTI registration.

  • For Corporations/Partnerships: Provide SEC registration, including Articles of Incorporation and by-laws.

6. Business Permit (Mayor’s Permit)

• A copy of your current Mayor’s Permit or Business Permit from your local government unit (LGU).

7. Proof of Garage

• Submit documents proving that you have a suitable garage for your trucks. This could include a notarized lease agreement for a garage space or a location map with a land title for the property.

8. Insurance Coverage

• Present comprehensive insurance coverage for each vehicle to be operated under the PA.

9. Affidavit of Undertaking

• An affidavit stating that you will comply with LTFRB rules and regulations, including the submission of additional documents once the full CPC is processed.

10. Tax Identification Number (TIN)

• A copy of your TIN or proof of registration with the Bureau of Internal Revenue (BIR).

11. Financial Statement

• Provide a financial statement or proof of financial capacity to operate the business.

12. Payment of Filing Fees

• Pay the required fees, which will depend on the number of units/trucks you're applying for. Keep the official receipt for submission.

13. Other Documents

• Professional Driver’s License for all drivers operating the trucks.

• Vehicle Emission Compliance Certificate from an accredited testing center.

• Photo of the Units (front, side, and back views).

Once you’ve completed and submitted these requirements, the LTFRB will process your application and may issue a Provisional Authority allowing you to temporarily operate until the full Certificate of Public Convenience (CPC) is released.

Process Timeline

• The Provisional Authority is valid for a limited period (typically three to six months) while the CPC is being processed.

• LTFRB may require a hearing or inspection before approving your application.
