Welcome to Okito! By using the Okito app, website, or any associated services, you agree to the following Terms and Conditions. These terms govern the legal relationship between you, the user, and Okito, Inc. (“Okito,” “we,” or “us”). Please read them carefully.

1. User Agreement

By creating an account and using Okito, you agree to comply with these Terms and Conditions and applicable laws and regulations.

Eligibility:

  • You must be at least 18 years old to create a Okito account.

  • Minors may only use the service when accompanied by a legal guardian.

Account Responsibility:

  • You are responsible for maintaining the confidentiality of your account information, including your password. Any unauthorized use of your account should be reported immediately to Okito.

2. Nature of the Service

Okito provides a platform that connects passengers with independent third-party drivers for transportation services. Okito does not provide transportation services directly. Drivers are independent contractors, not employees of Okito.

Service Availability:

  • Okito does not guarantee the availability of drivers at any particular time or location.

  • Service may be limited or unavailable in certain areas due to local regulations, demand, or other factors.

3. Payment and Fees

Fare Calculation:

  • Fares are based on the combination of distance, time, and demand. Final pricing will be displayed before you confirm your ride.

  • Surge pricing may apply during peak times, special events, or high-demand periods. You will be notified of surge pricing before booking.

Payment:

  • By booking a ride, you authorize Okito to charge your selected payment method for the total fare, which includes applicable taxes, fees, tolls, and any additional charges.

  • Okito accepts credit cards, debit cards, and other forms of digital payment as specified in the app.

Cancellation Fees:

  • You may be charged a cancellation fee if you cancel a ride after a driver has been dispatched. The cancellation fee will be displayed before confirming your cancellation.

Refund Policy:

  • Refunds are generally not provided unless there is an issue with the ride, such as driver misconduct or incorrect charges. To request a refund, you can contact Okito support through the app.

4. Driver and Vehicle Standards

All drivers using the Okito platform are required to meet the following qualifications:

  • Background Check: Drivers must pass a background check, including criminal and driving record screenings.

  • Vehicle Requirements: Vehicles must meet safety and quality standards set by Okito, including regular inspections and cleanliness.

Okito is not responsible for the condition of the vehicle or the conduct of the driver but strives to maintain a safe and reliable experience.

5. Passenger Conduct

When using Okito, you agree to:

  • Treat drivers and other passengers with respect and courtesy.

  • Refrain from engaging in any illegal, unsafe, or inappropriate behavior during the ride.

  • Wear a seatbelt and follow all applicable safety guidelines.

Prohibited Items:

You are prohibited from bringing illegal substances, weapons, or hazardous materials into the vehicle. Okito reserves the right to refuse service to anyone violating these rules.

6. Liability and Insurance

Okito provides insurance coverage for passengers during active rides (from the time a driver accepts a ride request until the ride is complete).

Insurance Coverage:

  • Passenger Protection: Passengers are covered by Okito’s insurance for injuries or damages incurred during the ride, subject to policy limits and local regulations.

  • Driver Responsibility: Drivers are required to maintain their own personal vehicle insurance in compliance with local laws. Okito’s insurance is secondary to the driver’s personal insurance.

Limitation of Liability:

Okito shall not be liable for indirect, incidental, punitive, or consequential damages arising out of the use of its services. Okito’s liability is limited to the extent permitted by law.

7. Surge Pricing

During periods of high demand, Okito may implement surge pricing. Fares will increase to reflect market conditions such as traffic, weather, or special events. Surge pricing will be displayed in the app before you confirm a ride.

8. Dispute Resolution

By using Okito, you agree to resolve any disputes or claims arising out of or relating to these Terms and Conditions through binding arbitration rather than in court.

Arbitration:

  • Disputes must be resolved through arbitration in accordance with the rules set.

  • Both parties waive the right to a jury trial or participation in a class-action lawsuit.

Class Action Waiver:

You agree to resolve disputes with Okito on an individual basis and waive the right to participate in a class-action lawsuit.

9. Data Privacy and Usage

Okito respects your privacy and is committed to protecting your personal information.

Data Collection:

  • Okito collects personal information, including location data, trip history, payment details, and communications with drivers.

  • This data is used to provide services, improve user experience, and for marketing purposes (with consent).

Data Sharing:

  • Your data may be shared with third parties, such as drivers, law enforcement (when required), or payment processors, in compliance with applicable laws.

10. Termination of Service

Termination by Okito:

Okito reserves the right to terminate or suspend your account at any time if you violate these Terms and Conditions, engage in illegal activities, or compromise the safety and security of the platform.

Termination by User:

You may terminate your account at any time by deleting your account through the app. All outstanding balances or fees must be settled before termination.

11. Modifications to Terms

Okito reserves the right to update or modify these Terms and Conditions at any time. If significant changes are made, you will be notified via the app or by email. Continued use of the service after such changes indicates your acceptance of the revised terms.
